Resolution directing the City Manager and requesting the U.S. Government and Congress make available all evidence held by the Dallas Police Department or any other federal agency regarding the Kennedy Assassination (Councilmember Garcia, co-sponsored by Councilmembers Palmer and Tandy). Councilman Garcia moved to adopt the resolution. Kennedy was the 35th President of the United States; and Whereas, John F. Kennedy helped in the struggle to end segregation in America and empower all of its citizens with the right to vote and equal citizenship; and Whereas, John F. Kennedy asked the people of America not what America could do for them, but what they could do for America; and Whereas, the American people continue to disbelieve the Warren Commission report that Lee Harvey Oswald acted alone in killing the president; and Whereas, there is renewed controversy over a possible conspiracy to kill the president based on the film "JFK" and its allegations of possible Dallas Police involvement in a coverup; and Whereas, the Dallas Police Department, Dallas Sheriff's Department, Dallas District Attorney's Office, and the Dallas Office of the FBI all participated in the investigation of the assassination; and Whereas, thousands of secret documents on the assassination have been closed to the public until the year 2029 by the Congress of the United States and the United States government and its agencies; Now, Therefore, BE IT RESOLVED by the City Council of the City of Dallas: Section 1. That the city manager is hereby directed to make available all files, documents, papers, films, audio, or any other evidence held by the Dallas Police Department or any City department or agency regarding the John F. Kennedy assassination, the murder of Lee Harvey Oswald, and Jack Ruby to the public and media immediately. Section 2. That the Dallas Police Department and other city departments transfer all John F. Kennedy assassination documents and related materials to the Dallas Municipal Archives and Records Center for preservation and release to the public. Section 3. That in the spirit of openness and believing in the peoples right to know in a free and democratic society, that the City of Dallas requests the United States Government, the Congress, and all federal agencies and committees involved in the investigation of the John F. Kennedy assassination release all documents, reports, film, videos, audio recordings, or other evidence regarding the Kennedy assassination immediately to the American people. Section 4. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter on the City of Dallas, and it is accordingly so resolved. Kennedy Records At this time the Dallas Police Department has collected several records related to the assassination of President Kennedy. These files include the Intelligence Division files, personnel files, Public Information Office files and copies of related offense and arrest reports. The above items have been collected from various Division Commanders within the Dallas Police Department. We are continuing our efforts by instructing all Police Department employees to forward any known related records. In addition, I am also taking actions to notify former employees in an effort to recover any "working files" that may have been retained under the assumption the files were personal property. All related records, including any located in the future, will be forwarded to your office for storage in the Dallas Municipal Archives and Records Center. Attached is a memo from the City Attorney's Office stating that the public's right to know takes precedent over any individual's right to privacy in this issue and the public should be given access to these files. /signed/ William M.
