The Clay Shaw preliminary hearing testimony of Endicott A. Batchelder
ENDICOTT A. BATCHELDER, after being first duly sworn by the Minute Clerk,
testified as follows:
EXAMINATION BY MR. DYMOND:
Q. Will you please state your name?
A. My name is Endicott A. Batchelder.
Q. Mr. Batchelder, are you connected with Tulane University?
A. I am the director of students' records and registration, which is also
known as the registrar.
Q. Are you here this morning in response to a writ of subpoena duces tecum
which was served on Tulane University, through its proper representative,
commanding the production in Court of the entire University record of one
Perry Russo?
A. I am.
Q. And do you have those documents with you?
A. I do, sir, an original and a photostat.
Q. May I have the original first?
A. Yes.
Q. I show you the document which you delivered to me, marking same for
identification, D-20, and ask you whether you can identify this as the Tulane
University record of Perry Russo?
A. This is the record, certified.
MR. DYMOND:
At this time we will ask that this record be delivered to the registry of
the Court for future use as evidence, if needed.
MR. OSER:
No objection.
JUDGE BAGERT:
Motion granted.
MR. DYMOND:
At this time I ask leave of Court to substitute photostatic copies for the
record.
JUDGE BAGERT:
Motion granted.
MR. DYMOND:
Before doing so, I will ask this witness whether this photostat copy which
I am presenting to you represents a true and faithful copy of the original of
the Tulane record?
THE WITNESS:
It is a true and faithful copy of the original, sir.
EXAMINATION BY MR. DYMOND:
Q. Let me ask you this; in addition to this record which you produced here
in Court today, are there any other records at Tulane, such as student
activity records or records other than scholastic records?
A. Nothing from my office. I do not have any records at all of student
records. It would be in the Dean of Students office.
MR. DYMOND:
I tender the witness.
MR. OSER:
No questions.
